I quite agree with you about the importance of fanfic. I would like to point out, however, that the problem with the lawyers is very likely NOT Misty's fault. As Weyrleader Second of Sunfall Weyr I've had to deal with similar issues concerning the works of Anne McCaffrey. The lawyers who cause all the fuss are the lawyers for the PRESS, not Ms. McCaffrey's personal attourneys. The authors hands are most often completely tied in matters of copyright, and the PUBLISHER is usually the "bad guy." I have one contract where I can't even quote from my own book without asking for permission from the press--which is really more than a little ridiculous, as far as I'm concerned. > Frankly, I think her work has gone to hell in a handbasked since she >went full time, and she needs to go back to waiting tables or whatever >job she had before this and spend a little time on a book instead of >cranking out six a year, which all read like first drafts of a really >good book. Yes, six first DRAFTS in a year is about right. As much as most authors hate rewriting, the adage that "all writing is 90% rewriting" is quite true, and if you don't put in that kind of time and effort on a book, it really shows. > I'm sorry. "Well, if you must, but here's a form, and don't do it >like *that*." Having seen the form in question, it is a perfectly standard form that is used absolutely everywhere in the publishing industry. I see them all the time as a screenwriter. In fact, Misty's form is extremely sedate compared to most of the forms I encounter in Hollywood. Again, I think this is a place to blame the lawyers, not the author. >I'd be bouncing-off-the-walls thrilled if a bunch of >people wrote me and said "I think Fauklin's so awesome; I'm taking my >D&D party through a gate, and what do you think is the minimum >constitution to be a Proudman, anyway? Actually, a brighter move--if the publishers would only wake up to the potential revenues--would be to hire competent game designers to create the RPGs! I think there are more than a few of us fans out here who would willingly fork over the cash for decent RPGs set in Valdemar and similar settings (I believe such a game does exist for ElfQuest, if memory serves.). > > Danya ------------------------------ Date: Sun, 8 Sep 1996 23:27:51 -0400 (EDT) From: Jake To: mercedes-lackey-+AT+-herald.co.uk Subject: Copyright / DragonCon / Mage War Message-ID: <199609090327.XAA01748-+AT+-orion.webspan.net> Heather Watson wrote: >Okay, I have no intention of designing a Valdemar RPG, but I just want >to rant about how I think it's asinine and generally sickening that you >can't do it for your own amusement. All right. This is the official-unofficial line from Misty about WHY. It's because Marion Zimmer Bradley got Zinged with it. It's not HER fault. It's the FEN that did it. MZB was cool on fanfic for a while. Hey, she encouraged it. What happened was that one of her novel outlines mirrored an idea that some fan sent her (which IIRC she did not read, I think she just trashed fanfic at that point). So the fan found out and SUED for a percentage of the profits, and she wound up scrapping the whole thing. Sure, it didn't ruin her, but it ruined her work. Or that work, to be specific. That started the trend. And Misty doesn't want to have the same thing happen. So she has that release form. She doesn't even want to SEE fanfic because of that. I'm sure she's tickled pink that so many people love her work. But I for one see and agree with what she says. Writing is difficult enough! I mean, how would YOU feel, as an author, if someone, somewhere, came up with an idea in their fanfic and sued YOU for profits of your own sweat and blood when it had nothing to do with it? The question here is why can't FANS be gracious of work. Not why can't authors be gracious of fans. It takes ONE bad apple to ruin it for everyone. Some fans don't understand that there's a line between fandom and ridiculousness. And they kill the experience for the 99 44/100% of the good ones. But I agree with you that her work is in decline. You're right in saying her plots are about storylines now instead of characters. It really is bad. A majority of the sources I have on writing says the BEST writing is character-based, with one POV, usually. The multi-POV stuff is what bogs down. ===================== ALL RIGHT. Sort of related. I just got back from a vacation in sunny Las Vegas. The great thing is that I didn't lose all of my money. Unfortunately, I can't possibly read all 400 messages on my email, so I'll just go with some of the more recent ones. > Jaguar said > > Nope! That's Michael Wincott. As for Michael Wincott, he'd make an excellent Ancar. I think it's his voice. Nina P.S. I love B5, too. Marcus, Garribaldi and Delen are my favorite characters. I just saw a rerun of the episode where B5 breaks from the Earth Alliance. Very cool. And, on another note, I also love Tamora Pierce. I've been trying to find the Lioness series in hardcover, but I haven't had that much luck. ------------------------------ Date: Mon, 9 Sep 1996 11:08:25 -0400 (EDT) From: undine To: mercedes-lackey-+AT+-herald.co.uk Subject: Re: Copyright in Reference to MZB Message-ID: On Mon, 9 Sep 1996, Jake wrote: > All right. So the fan found out and SUED for a percentage of the profits, and > she wound up scrapping the whole thing. Sure, it didn't ruin her, but it > ruined her work. Or that work, to be specific. Actually what happened (I know cuz I was reading the Darkover newsletter at the time) is that a fan wrote a short story about Dyan Ardais. MZB writes a novel about Dyan and wants to incorporate an idea from the fan's story. Fan agreed. Then Fan insisted on co-author status and part of the royalties. Evidently the Fan was rather obnoxious and demanding. Remember that the Fan was contributing an idea not any actual writing. MZB declined (vehemently IIRC). So as not to incur legal action from fan, MZB scrapped the novel and also stopped editting the Darkover anthologies. :( So actually I don't think that we can blame MZB's rabid Fan on Misty's reticence to allow fanfic since the Dyan Ardais book incident happened in the last 5 years IIRC. And I do believe that Misty has always had a no unauthorized fanfic policy. Actually, I think it's interesting that Misty doesn't encourage fanfic since she got her start writing in other people's (MZB & Andre Norton) worlds. Undine Who shall now go try to sell some books. Well, the mean, moody and magnificent rarely end books mm&m, they're either dead or tamed by the lurve of a good whatever. * I've always been quite taken with Lan, altho' seeing as how he's quite taken with Nynaeve, there's maybe something not quite right with the man; * Hettar before Eddings' women got at him; * Silk (ditto Eddings and his women); * Whatsit from the Far Pavilions - a bit upright, a bit decent, but deary me, the man can do anything! * I'll definitely second the cad from les Liaisons Dangereuse (especially as played by Doodit - oh Gooooooooods - names, EE, get some names, the version with Glen Close in); * Lovelace from Clarissa; * Seth from Cold Comfort Farm; * Alan Rickman's Sheriff of Nottingham from Prince of Thieves (saw it again on the TV over the weekend - he was brilliant, Costner was not -"You, my room, 10:30. You my room 10:40, and bring a friend" weg!); * the italian guy at work who drives the black Saab convertible, and is ab-so-loot-ly drop-dead gorgeous (don't know if he'd be exactly *bad* for me , but my ol' man might object)! erm, difficult this innit? The place to find dastardly bastards is in the bodice rippers I'm afraid, they're all stunningly handsome, broad of chest, tight of butt, steely eyed, strong, heroic types, emotionally stunted and seeing women as their God-given right, (rampantly hetero, and probably quite fancying their best mate really, - what, gay? ME?) Obmisty: Why isn't Alberich paired off? Is he straight, gay, human? Is he suffering from a broken heart? When is Misty going to write, "Alberich, the Love Story"? Is he suffering from unrequieted love - and if so, who is it that he loves from afar? How about a book about a Herald who gets fixated on their Companion (like Shells in The Ship who .....) - or a Companion who gets fixated on their herald? Can their love cross the divide? Will their love survive? Do we give a toss? Good grief - look at that, lots of Obmisties (Obmistys?), I should save them and dole them out, one day at a time - on second thoughts, maybe not, hey ho, another day down, another day older, ...... ciao ciao sweeties, Esmeralda ------------------------------ End of MERCEDES-LACKEY Digest 817 *********************************
