In her early novels I always cared about her characters and what might happen to them. However, in the last few books i just didn't seem that attached to the main characters. I wonder if she has fallen into the same rut as other prolific authors,i.e. Stephen King,Dean Koontz. After their first say five novels everything becomes very predictable and a malaise seems to have set in. It has been done with many famous books (the one that comes to mind is Gone With the Wind) The copyright can also be renewed by "The Mercedes Lackey Estate" at which point it will never expire (or can be more easily renewed)! This is what was done with Gone With the Wind. The copyright is held by "The Margaret Mitchell Estate". Just a note to all on this. I for one, agree totally with copyright laws. Misty owns them, and it is her right to say what can be done with them. I cannot make a sequel to the game Duke Nukem 3d without 3DRealms permission, and I would never do that. Copyright laws protect Misty's work, just as they will protect your work. Misty does not mind this mailing list. I am pretty sure she could shut it down tonight if she wanted to. Lets see: You can't write a story about anything from Misty's works using any of her specific terms such as Shin'a'in, Tale'sedrin, HawkBrothers etc. (more than fair - that bit I fully understand and agree with.) but that you can not write anything that is "derivative work" and that "changing a few names is not going to get around that fact"?. Well the way I see it, just about all Fantasy and Science Fiction is a derivative of some other writers ideas or folk/faery tales handed down from times long ago. Sure, Companions are great and who wouldn't want to be Chosen but Stephen Donaldson had a similar concept with intelligent horses that choose their riders in the Chronicles of Thomas Covenant. There are many other authors who have written about intelligent, mind-speaking animals. How many authors write about telepathy, empathy, the ability to fore-tell the future? What about ley-lines, magical nodes - I'm kinda certain I've read novels with these things before. Authors and Creators like Tolkien, C.L. Moore, Marion Zimmer Bradley, David Eddings, Heinlein, Julian May, Andre Norton, C. J Cherryh, J. M. Straczynski, George Lucas, Spider Robinson, Tad Williams (I don't think I really need to go on) The way I'm beginning to understand this, it appears to mean that in the privacy of my own home, if I and a group of friends want to run a private role-playing game based in Misty's world we can't. Nor can we play a game using mind speech, intelligent horses and/or birds, heralds (which is not a term Misty invented but a historical office), wars, gods, evil magicians because these can all be derived from Misty's works. By that same reasoning, I can only assume that no-one can write any more fantasy and/or sci-fi because it could be traced back. Now please, don't get me wrong, I drive my partner mad with my Misty addiction. Whenever he picks me up from work and I'm sitting engrossed in a book, he knows it's a Misty. I finally convinced him that handing over his credit card so that I could order through Firebird Arts was a good thing (4 CD's so far, many more to go :) ), I think by this I mean that I am a die-hard Misty fan and agree that she should be very protective of her intellectual property but I must disagree with the idea that you cannot use some of the basic ideas that she herself has adapted from other works. If i have gotten of the track, please let me know but i cannot make any sense out of the messages I've been receiving on this list and it's driving me bananas - as well as driving my house mates mad 'cause I keep complaining and rattling on about this. If you were clearly using "Heralds" in the specialized way that Misty uses it, then you would be clearly creating a derivative work, but if you stuck to the historical definition, or created your own character type and called it a herald, you would be fine. Of course, if you created a game in which all of those elements occured in the same relationships to one another as they do in Misty's work, you would be wading into deep kimchee.
