I don't know of any need to commit fraud in getting refills.  They don't
make you sign an affidavit attesting that you're using the dose each day or
have already used the previous dose do they?

Perhaps, when convenient, you could just get an obnoxious 4-pill refill
whether you've had a migraine or not.  In fact, you might well be able to
talk to the pharmacist (or pharmacy supervisor) about the situation and tell
them that you might be getting doses on consecutive days in case they want
to optimize breaking the 9-pill packs for you.

That way, you could build up a small but adequate reserve.

Maybe the pharmacy can/would intercede with the insurance company for you.

Perhaps you could even look into filing a complaint with the state insurance
regulatory board.  Nobody should have to put up with that treatment.  (Or,
is it some government insurance for military personnel and dependents?  If
so, congress-critters can sometimes help.)
